General information


This Privacy and Cookie Files Policy of the hereinafter referred to as the stipulates the rules of processing and protection of personal data as well as the use of cookies and other technologies such as Google Analytics .


§ 1

Definitions


For the purposes of this Privacy Policy, the following terms shall have the following meanings:

  1.   2. Website - the service available at www.buenavistamediagroup.pl

  3. User - any entity viewing the contents of the Website

  4. GDPR - Regulation of the European Parliament and the Council of the European Union (EU) 2016/679 of April 27, 2016, on the protection of natural persons with respect to the processing of personal data and the free flow of such data, as well as the repealing of Directive 95/46/WE

 

§ 2

Personal data


  1. The administrator of the User's personal data within the meaning of GDPR is the Administrator.

  2. The User may provide his or her personal data to the Administrator using the forms available on the Website, i.e. the contact form.

  3. The legal basis for the processing of Users' personal data is the User's voluntary, specific, conscious, and unambiguous consent given by means of a relevant form provided on the Website.

  4. Personal data may also be processed in cases where the Administrator is authorised to process personal data on the basis of the provisions of law or for the purpose of the performance of an agreement concluded between the parties.

  5. Personal data provided to the Administrator by the User via the contact form is processed in order to respond to the inquiry sent by means of the form. Providing personal data by the User is voluntary, but it is necessary for the User to receive a response. The processing of data for this purpose is based on a legitimate interest exercised by the administrator (Art. 6, sec. 1, item f) of GDPR). This data will be processed until the correspondence has been terminated and 2 years after the correspondence has been terminated.

  6. The Administrator may entrust personal data to other entities, with the assistance of which it fulfils the purposes indicated in the previous points (e.g. companies providing hosting services, an accounting company, or parcel delivery companies). The Administrator guarantees the confidentiality of all personal data provided to it.

  7. Personal data is collected with due care and adequately protected against access by unauthorised persons, and the processing thereof is conducted in accordance with and under the conditions set out in detail in the following:

    • Regulation of the European Parliament and the Council of the European Union (EU) 2016/679 of April 27, 2016, on the protection of natural persons with respect to the processing of personal data and the free flow of such data, as well as the repealing of Directive 95/46/WE,

    • the Act of July 18, 2002, on the provision of services by electronic means,

    • the Act of May 10, 2018, on the protection of personal data.

 

§ 3

User’s rights


  1. The User is entitled to the rights related to the processing of his or her personal data, including the following:

    • the right to access his or her data

    • the right to have his or her data altered

    • the right to have the processing of his or her data limited

    • the right to object to the processing of his or her data

    • the right to have his or her data removed (the so-called right to be forgotten)

    • the right to have his or her data moved,

    • the right to lodge a complaint to the supervisory authority in connection with the processing of personal data by the Administrator

  2. The User has the right to withdraw his or her consent at any time if the User has previously expressed such consent.

§ 4

Information to be collected


  1. When the User uses the Website, data about him or her is automatically collected. This data includes IP address, domain name, browser type, and operating system type. This data can be collected by cookie files (cookies) and can also be saved in server logs.

  2. Cookies are files sent to the User’s computer or another device (e.g. laptop, smartphone, or tablet) while the Website is being browsed. Cookies remember the User’s preferences, which enables him or her to improve the quality of service, improve search results and the accuracy of the information displayed, as well as track the User’s preferences anonymously.

  3. The User consents to the Administrator’s storing or accessing cookies on the User’s device by means of the browser settings installed on the User's device.

  4. The User may opt out of cookies by selecting relevant settings in his or her web browser. In such an event, the use of the Website by the User may be hindered (e.g. the website may work more slowly).

  5. The User may delete existing cookies from his or her device by using relevant functions of his or her web browser or programs designed for this purpose, or by using relevant tools available under the operating system he or she is using.

  6. The use of the Website involves the transmission of queries to the server on which the Website is stored. Every such query is saved in the server logs. The logs include the User's IP address, the date and time of logging in to the server, as well as information about the web browser and operating system used.

  7. The data stored in the server logs is not associated in any way with specific Users of the Website and is not used by the Administrator to identify the User. The server logs are used to administrate the Website, and their content is not disclosed to anyone other than those authorised to administrate the server.

  8. The Website uses technologies that anonymously record the actions taken by the User when using the Website. These include the following:

    1. Google Analytics - used to analyse Website statistics

  9. The data collected by these tools is not associated in any way with specific Users of the Website and is not used by the Administrator to identify the User.

  10. The result of applying the technologies specified in § 3, item 8 will be optimisation of the Website, its content, and the Product range with the User’s needs in mind.

 

§ 5

Purposes of data processing


Data provided by the User or collected automatically is used by the Administrator for the following purposes:

  1. ensuring proper operation, configuration, and security of the Website,

  2. monitoring the session status,

  3. analysis, research, and audit of the Website views,

  4. as well as for statistical and marketing purposes.

 

§ 6

Final provisions


  1. Changes may occur in this document, which may be affected by developments in Internet technology, changes to the data protection law, and the development of our Website. All changes will be promptly communicated to the Users in a visible and understandable manner.
